These Terms of Service ("Terms") are a legal agreement between you and myScout® ("myScout," "we," "us," or "our"). They govern your access to and use of our website at myscout.ai, our application, and related services (together, the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
You must be at least 18 years old and able to form a binding contract to use the Services. When you create an account, you agree to provide accurate information and to keep it current. You are responsible for keeping your login credentials secure and for all activity that happens under your account. Tell us promptly if you suspect any unauthorized use.
Some Services are offered on paid plans, billed monthly or annually as described at the time of purchase. By choosing a paid plan, you authorize us to charge the applicable fees to your payment method on a recurring basis until you cancel. Fees are stated exclusive of taxes, which may be added where required.
You agree to use the Services lawfully and only for legitimate business purposes. You will not: misuse, scrape, resell, or redistribute data from the Services except as expressly permitted; attempt to gain unauthorized access to the Services or related systems; interfere with or disrupt the Services; use the Services to send unlawful, harassing, or unsolicited communications; or use the Services in violation of applicable privacy, anti-spam, or data protection laws. You are responsible for how you contact and engage with prospects, including obtaining any consent the law requires.
The Services, including all software, content, branding, and the myScout® name and logo, are owned by myScout or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Services for your internal business purposes during your subscription. You may not copy, modify, or create derivative works from the Services except as expressly allowed.
Our handling of personal information is described in our Privacy Policy, which is part of these Terms. You are responsible for ensuring that your use of any data obtained through the Services complies with applicable law.
The Services may link to or integrate with third-party tools and websites that we do not control. We are not responsible for the content, policies, or practices of those third parties, and your use of them is at your own risk and subject to their terms.
The Services are provided "as is" and "as available." While we work hard to keep our data useful and accurate, we do not warrant that the Services or any data will be uninterrupted, error-free, or complete. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, myScout will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising out of or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us for the Services in the twelve months before the event giving rise to the claim.
You agree to indemnify and hold harmless myScout and its officers, employees, and agents from any claims, damages, or expenses arising out of your use of the Services or your violation of these Terms or applicable law.
You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms or if needed to protect the Services or other users. On termination, your right to use the Services ends, though provisions that by their nature should survive will continue to apply.
We may update these Terms from time to time. When we do, we will post the updated version on this page and revise the effective date above. Your continued use of the Services after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules. Any dispute relating to these Terms or the Services will be brought in the state or federal courts located in Pennsylvania, and you consent to their jurisdiction.
